Terms of Service

These terms are written in plain language but are a binding legal agreement. We recommend consulting a qualified attorney before relying on these terms for compliance purposes.

1. Acceptance of Terms

By accessing or using the Gravelo API, website, or any related service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

If you do not agree to these Terms, do not use the Service.

2. Service Description

Gravelo provides an application programming interface (API) that aggregates publicly available US government data — including flood zone data from FEMA, air quality readings from EPA AirNow, river gauge data from USGS, wildfire risk ratings from FEMA NRI, and seismic hazard data from USGS — and returns normalized risk scores for a given geographic coordinate or US address.

The Service is intended as an informational tool for software developers and data analysts. It is not a substitute for professional engineering analysis, licensed insurance underwriting, official FEMA flood insurance rating, or any regulatory determination.

3. Data Accuracy & Disclaimer

All data returned by the Service is sourced from US government agencies and is subject to the limitations of those sources, including update frequency, geographic coverage gaps, and data quality flags. Specifically:

  • Air quality data from EPA AirNow is preliminary and subject to change. It is not for regulatory use.
  • FEMA flood zone designations reflect the most recently available FIRM data in our database and may not reflect the most current official flood maps for a given location.
  • Earthquake PGA values are derived from USGS probabilistic seismic hazard analysis and represent modeled estimates, not site-specific engineering assessments.
  • Wildfire risk ratings from FEMA NRI are census-tract-level aggregates and do not account for parcel-level conditions.

Gravelo makes no representation that risk scores are accurate, complete, current, or suitable for any particular purpose. Risk scores are not insurance ratings and should not be used as the sole basis for any insurance, lending, real estate, or life-safety decision.

4. Acceptable Use

You agree that you will not use the Service to:

  • Make or communicate official regulatory determinations under NFIP, FIRM, or any federal or state program
  • Operate or inform systems where inaccurate data could result in loss of life or physical harm
  • Re-sell, sublicense, or redistribute raw API response data as a standalone data product without written permission from Gravelo
  • Reverse engineer, scrape, or circumvent rate limits or authentication mechanisms
  • Exceed your plan's monthly call quota through automated means designed to bypass billing
  • Use the Service in violation of any applicable law or third-party rights

You are responsible for ensuring your use of the Service complies with all applicable laws in your jurisdiction, including any laws governing the use of location data or risk assessments.

5. API Keys & Account Security

You are responsible for maintaining the confidentiality of your API key(s). You must not share API keys publicly (e.g., in client-side code, public repositories, or published documentation). All calls made with your API key are your responsibility regardless of whether you authorized them.

If you believe your API key has been compromised, you must revoke it immediately through your dashboard and generate a new key. Gravelo is not liable for charges or data exposure resulting from unauthorized use of your API key.

6. Payment & Subscriptions

Paid plans are billed monthly via Stripe. By subscribing, you authorize Gravelo to charge your payment method on a recurring basis. All fees are stated in US dollars and are non-refundable except as required by applicable law or at Gravelo's sole discretion.

Gravelo reserves the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

If a payment fails, your account may be downgraded to the free tier and API access may be suspended until payment is resolved.

7. Termination

You may cancel your account at any time through your dashboard. Cancellation takes effect at the end of the current billing period.

Gravelo may suspend or terminate your access immediately, without notice, if you breach these Terms, engage in fraudulent activity, or use the Service in a way that could harm Gravelo, its infrastructure, or other users.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRAVELO AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PROPERTY DAMAGE, OR PERSONAL INJURY, EVEN IF GRAVELO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Gravelo's total aggregate liability for any claim arising out of these Terms or your use of the Service shall not exceed the greater of (a) the total fees paid by you to Gravelo in the three months preceding the claim, or (b) $100 USD.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. GRAVELO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Data Attribution

If you display or publish data returned by the Service in a user-facing product, you must attribute the underlying data sources (e.g., "Flood data: FEMA NFHL", "Air quality: EPA AirNow"). You may not represent Gravelo's risk scores as official government determinations.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

12. Changes to These Terms

Gravelo may update these Terms at any time. We will notify you of material changes by email or by posting a notice on gravelo.io. Your continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms.
